I read there was a kid who got busted with a bag of parsley in Florida. Yes, you read that right, actual police arrested an actual 15 year old with a bag of parsley, and charged him with intent to deliver a counterfeit controlled substance. This is the first I'd heard of this sort of nonsense. So those of us with enquiring minds want to know: what the hell is a conterfeit controlled substance? I just thought I'd let the public at large know that in Florida at least the law reads, in part:
(a) A controlled substance named or described in s. 893.03 which, or the container or labeling of which, without authorization bears the trademark, trade name, or other identifying mark, imprint, or number, or any likeness thereof, of a manufacturer other than the person who in fact manufactured the controlled substance;
The statute also references 893.03: "Standards and schedules", which is a HUGE list of proscribed chemicals and analogues. Nowhere in any of it do I find any reference to parsley in unmarked kitchen bags. As I read it, there is nothing criminal here at all, just retarded kids and stupid cops. Perhaps someone might sue the bastards; they won't even play by their own outrageous rules and have started arresting people for things that aren't even illegal.
